offtheave respects the rights of artists and creators, and we respond to copyright notices under the U.S. Digital Millennium Copyright Act (DMCA). If you believe something uploaded here infringes a copyright you own or manage, send us a notice. When it’s complete, we take the material down and tell the member who uploaded it.

2Before you send a notice

• Make sure you own the copyright or are authorized to act for the owner.
• Think about whether the use might be allowed, for example by a license, a sample clearance, or fair use (commentary, criticism, parody). A notice must be sent in good faith.
• If you know the uploader, it may be faster to ask them to take it down.
• Your notice is a legal document. Knowingly misrepresenting that material is infringing can make you liable for damages, including costs and attorneys’ fees.
• We send the uploader your name (or your company’s) and the details of the notice so they can respond. We don’t share your email, phone or address with them.

3Send a copyright notice

Fill in every part. An incomplete notice slows things down, because we have to ask you for what’s missing.

4What happens next

1. We review your notice, usually within 1–2 business days.
2. If it’s complete, we make the material private, so only the uploader can see it, and email you.
3. We tell the uploader, with your name and the notice details, and count it as a strike on their account.
4. If something is missing, we email you to say what, and you can send a new notice.
5. If the uploader sends a valid counter-notice, we forward it to you. Unless you tell us within 10 business days that you’ve filed a court action to stop the infringement, we may restore the material.

5If your upload was taken down

We email you and send a notification when a copyright notice takes down something you uploaded. It stays in your library, but only you can see it, and you can’t make it public again while the notice is in effect.

If you believe it was taken down by mistake or misidentified, for example because you made it, you have a license, or the use is fair use, you can send a counter-notice below. Only send one if you’re sure: it’s made under penalty of perjury, and the person who filed the notice gets your contact details and may take you to court.

6Repeat infringers

Each valid notice that takes down your uploads counts as one strike, however many items it lists. When an account gets 3 strikes in 12 months, we close it.

• A strike goes away if we restore your upload after a counter-notice, if the notice is withdrawn, or if we made a mistake.
• Uploading the same material again while a notice is in effect counts as new infringement.
• We may close an account sooner in serious cases, such as uploading many works you clearly don’t own.
